Summary

  • Mr. Xu Jianfeng concentrates his practice on insurance, maritime, complex tort, personal injury, products liability, common corporate and commercial matters.

    He regularly advises domestic and overseas underwriters on policy liability, investigates sinking of the insured ships and collision, recovers for cargo damage, and defends against third party claims under various liability policies. He also advises clients on compliance and regulatory matters. He defends domestic and foreign manufacturers against claims for product liability and also takes recovery against those who contributed to or caused the defect of the product in problem.

    Thanks to his working experience with a property and casualty insurance company Mr. Xu has much understanding with insurance industry and is able to think from not only legal aspect, but also business aspect. Since 2012 he has been ranked as a notable practitioner in Chambers & Partners Asia-Pacific (Insurance, PRC Firms).

    With over a decade’s practice in China, Mr. Xu has extensive trial experience with PRC proceedings. He appeared a lot of times before the Supreme People's Court of China on various kinds of cases, and succeeded in protecting interests of foreign clients by having the Supreme Court overrule one judgment granted by local provincial High Court which was much unfavourable to clients.

    He recently advised several insurance companies on policy and recovery issues arising from loss of large quantity of luxurious cars sustained during the tragic Tianjin explosion which happened on 12 August 2015. He also succeeded in a tough recovery against the party providing the contaminated chilli with Sudan Dye to a major supplier of KFC for the underwriter of product liability policy through litigation.

    Mr. Xu is admitted to the Bar of P.R.China and is qualified to practice in all China Mainland regions. He is also a member of the Committee on Insurance Law of Shanghai Bar Association.

    Mr. Xu worked with the People's Insurance Company of China (PICC), Shanghai Branch before he started practicing with a professional shipping and insurance law firm in the year 2003. He worked with Holland & Knight LLP, New York Office as trainee in 2006.

  • Representing PICC, CPIC, China Continental Insurance, Alltrust Insurance, AIG, Sompo Japan, Tokyo Marine, China-Life Property Insurance, Tai Ping, Bank of China Insurance, Falcon Insurance HK, Brit UW Limited, Beazley Underwriting Ltd, Starr Syndicates Limited in matters relating to various policy issue and recovery matter;
  • Representing the insured, as per instruction of the liability insurer, to defend third- party- claims.
  • Representing P & I clubs in wet cases and crew claims, for example, “Miranda Rose” c/w “Weilun 06” (which is published as the Precedent case No. 31 by the Supreme Court of China), “Maritime Anita” c/w “Siam Bridge”, “Si Hang Fen Jin” c/w “The Nobel”, “Argent Cosmos” c/w dock of Chengxi Shipyard & Co., Ltd, CSSC; SANCHI c/w CF Crystal, Jing Fan 1 c/w “Maxima”
  • Representing an international cruise operator in various claims for personal injury happened on board. Two have been selected by the High court as precedents on the duty of providing a safe environment as the manager of a public space under Chinese law.
  • Representing foreign clients to pursue claims against Chinese entity for matters relating to sale of goods, investment on real estate, equity investment, etc.
  • Advising foreign law firms on Chinese law.
